 These Terms apply to using the website, including browsing, purchasing products through our online store, giving us any shout out or review and accessing any related tools, content or services. You agree to these Terms by using our website.

Herbal House Pty Ltd ACN 695 278 356 (Herbal House) owns and operates this website and online store. Our website is important to us. The material on this website (including without limitation images, photos of our products, product descriptions, text, branding, software and information) is protected by copyright under the laws of Australia and the laws of other countries under international treaties. Do not copy, communicate, adapt, transfer or distribute any of the contents without our written permission first. No trade mark or logo on this website may be used in any way without prior written permission.

Promotions
We might publish certain competitions, offers, programs or promotions on our website. We will set up a dedicated space for any applicable T&Cs so make sure you check those terms before entering or participating. We will sometimes add, remove, alter or amend competitions or promotions on our website as permitted by law, so do check back in.

Personal use only
You may only use this website for lawful and personal purposes unless we provide written consent otherwise. You are not permitted to purchase any of our products for resale to a third party for retail, wholesale or trade purposes without our prior written consent.

2           PURCHASE TERMS

Account registration
Seen something you like? To purchase our products you may decide to set up an account and be logged in using a valid email address. You are responsible for ensuring that your account details are accurate and up to date, and for keeping your account details and password confidential – we can’t keep track of that, so please take care.

Age restriction
You must be at least 18 years of age to use this website and purchase products from our online store. By using this website, you confirm that you are at least 18 years old. We do not knowingly sell products to persons under 18 years old.

Orders
To place an order, it’s easy. Just follow our website prompts. We only accept orders from Australia at present. If you are located in New Zealand, please get in touch. 

Accepting orders
Each order that we accept results in a separate binding agreement between us for the supply of that product on these Terms. We reserve the right to accept or reject your order for any reason, including if the requested product is not available, there is an error in the price or product description on this website or an error in your order – but we will be sure to let you know as soon as possible. We also reserve the right to limit quantities of any product to any person, household or order at our discretion.

Prices
The price charged will be the price displayed at the time you place your order. Prices are subject to change without notice. Please check the pricing at the time of purchase.

Payment
All prices are in Australian dollars and are inclusive of any applicable GST. We accept payment via debit or credit card (Visa or Mastercard), or any other payment method or express checkout provider listed on checkout. You will be charged during the purchasing process and prior to delivery. If we are unable to charge your credit or debit card due to insufficient funds or other errors your order will be cancelled, and we’ll get in touch.

Delivery 

·       Delivery is available within NSW and Victoria.

·       We will deliver products via Australia Post or another carrier to the Australian delivery address you have nominated in your order.

·       Orders placed before 10:00 AM AEST on business days are typically dispatched the same day. Orders placed after 10:00 AM or over weekends and public holidays will leave our warehouse on the next business day.

·       Once your order is dispatched, it is not possible to change your nominated delivery address.

·       You will receive a tracking number via email once your order has been dispatched. If you are not home to receive your order it will be taken to the nearest Post Office or depot for safekeeping and you will need to collect it. Alternatively, if you have chosen to receive unattended delivery, we will leave your order in a suitable spot at your nominated delivery address.

·       Delivery times may vary depending on the carrier and delivery address. We recommend allowing at least 7 business days for delivery.

·       If applicable, delivery fees will be communicated to you before you place your order and must be paid at the same time and in the same manner as you pay for your order.

·       Risk in products passes to you on the date and time of delivery to the delivery address nominated in your order (including for unattended deliveries). You are responsible for the safe keeping of your order once it is left at your nominated address.

·       You promise and warrant that the person receiving products at your nominated delivery address is authorised by you to do so.

Product descriptions
We make every effort to display our products accurately on this website, including colours, dimensions and specifications. However, colours and appearance may vary depending on your device and screen settings. Product descriptions, specifications and availability are subject to change without notice. Please carefully check the listing at the time of purchase.

Changing or cancelling orders
Once you have placed an order, we start picking and packing quickly so we can get it to you fast. For that reason, we generally can’t change or cancel an order, or change a payment method, once an order has been placed. If you need to make a change, please contact us at support@herbal-house.com.au as soon as possible. If your order hasn’t been picked and packed yet, we’ll do our best to help.

Out of stocks and substitution
It’s rare, but if you place an order for a product that is out of stock or unavailable, we will contact you to notify you as soon as possible and arrange either a refund or supply of a substitute product if you prefer.

Change of mind
We want you to love what you order from us, so please choose carefully as we are not required by law to provide a refund or return for change of mind, personal preference or incorrectly purchased products. As a goodwill gesture, we may offer a store credit for items returned within 14 days of delivery, provided they are unopened, unused and in their original packaging. Return postage will be at your cost, and store credits are issued at our discretion.

Returns and refunds
If you receive a damaged or faulty product, please contact us at support@herbal-house.com.au with clear photos or videos of the issue, your contact details and your preferred outcome (repair, replacement, refund or store credit). Please ensure that you keep hold of any damaged products until we advise that they can be discarded. We reserve all rights where a product is found not to be faulty or has been misused or incorrectly installed. Our products come with guarantees that cannot be excluded, restricted or modified under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law if we breach a consumer guarantee.

Warranty
Read more about our Warranty. We do not warrant that any product will be suitable for any particular purpose beyond its described intended use for lawful indoor gardening, horticulture or agriculture.

Lawful use only
Our products are sold for lawful purposes only, including legal indoor gardening, horticulture, agriculture, research and commercial cultivation authorised under applicable laws. You must not purchase, use or intend to use any of our products for any unlawful purpose, including the cultivation, production, manufacture or processing of any prohibited plant, controlled substance or illicit drug under the laws of any Australian state or territory or under the Criminal Code Act 1995 (Cth). By placing an order, you represent and warrant that you will use our products solely for lawful purposes. We reserve the right to refuse, cancel or suspend any order or account where we reasonably suspect that products may be used for unlawful purposes. We are not liable for any loss, damage or consequence arising from the unlawful use of our products.

Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded, restricted or modified under the Australian Consumer Law. For major failures with any goods, you are entitled to choose a refund or replacement. If a failure does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund of the price paid for the goods and to cancel any contract for the service and obtain a refund of any unused portion. You are also entitled to compensation for any other reasonably foreseeable loss or damage from a failure in the goods or service.

3      REVIEWS AND CONTENT

Reviews
We want to hear what you think, but we also have a responsibility to keep this a safe space. Any materials or content you submit may be changed, condensed or deleted if we reasonably consider it to be in violation of content guidelines or any other provision of these Website Terms. We cannot guarantee that you will be able to edit or delete any material or content you have submitted. Ratings and written comments are generally posted in a timely manner, however we reserve the right to remove or refuse to post any submission including if we reasonably consider the post to be in breach of these Terms or other applicable content guidelines. You acknowledge that you are solely responsible for the contents of any review or submission you make.

Materials and Content
By submitting any materials or content to us via this website or any product review service offered, you promise (representing and warranting) and agree that:

·       you are at least 18 years old;

·       the details you submit are true and correct, and not known by you to be false, inaccurate or misleading;

·       you are the sole owner and have all necessary rights, consents and licenses to submit and publicise the materials or content and grant the rights required by these Terms;

·       any submission by you will not be unlawful, defamatory, hateful, offensive, unlawfully threatening or harassing;

·       you were not compensated by any third party or granted any compensation or consideration; and

·       you will not include any third party contact details, phone numbers or personal information.

Licence
If you post any material or content on our website, you grant us and our agents, affiliates and assignees an irrevocable, perpetual, sublicensable, royalty-free, worldwide licence to use, adapt and modify that content without compensation, attribution or liability. You promise and warrant you have the full authority to grant these rights.

We may collect and use your personal information in accordance with Australian privacy laws and our Privacy Policy which you can read using the link below. By submitting your personal information to our website, you agree that we may use your personal information to contact you about your request, administrative purposes and for any other purpose permitted or required by law. We may also use it to send you electronic marketing materials about our goods and services, which you can opt out of at any time.

Shopify
Our online store is hosted by Shopify, so certain personal information may also be collected and processed by Shopify in accordance with Shopify's Privacy Policy. By using this website, you acknowledge that your information may be transmitted to and processed by third parties, including Shopify and payment providers, which may be located outside Australia. While this website and online store is powered by Shopify, any purchases you make are made directly with Herbal House, not with Shopify. Shopify is not responsible for any aspect of any sale between you and us, including any injury, damage or loss resulting from purchased products.

5           GENERAL

 Termination
We may stop making this website available without prior notice. If we cease operating the website, any orders already submitted by you and accepted by us will not be impacted unless the relevant products are no longer available or we are prevented from supplying those products, in which case we will notify you and provide a full refund.

Applicable law
We operate this website from Australia. The laws of Victoria govern these Terms. If any part of these Terms is found to be unenforceable, you agree that the rest remain in full force and effect.

Global notice
We make no representation that this website complies with any laws outside of Australia, even if you are accessing this page from another country.
